Step 1: Paving the Way – Conducting a Trademark Search

Step 2: Filing the Application – A Step towards Protection

Once the comprehensive search is completed, the applicant must file a well-structured trademark application with the UAE Ministry of Economy. The application must include the following information:

  • The name and address of the applicant
  • A clear representation of the trademark
  • A list of goods and/or services for which the trademark will be used
  • A power of attorney (if the application is filed by a representative)
Step 3: Evaluation and Scrutiny – The Ministry’s Review Process

The UAE Ministry of Economy diligently examines the trademark application to ensure its compliance with all registration requirements. The goal is to safeguard the integrity of the trademark system and protect the interests of both applicants and existing trademark holders.

Step 4: Making It Public – Publication of the Trademark

With the approval of the trademark application, the proposed trademark is published in the esteemed UAE Trademark Gazette. This publication lasts for a duration of 30 days. During this period, any concerned party has the opportunity to file an opposition if they believe the registration of the trademark may adversely affect their rights.

Step 5: Achieving the Goal – Trademark Registration

In the event that no opposition is raised within the 30-day window, the trademark is officially registered, and the UAE authorities issue a well-deserved certificate of registration. The applicant can now enjoy the exclusive rights and protection that come with a registered trademark.

The duration of the entire trademark registration process in the UAE can vary depending on factors such as the intricacy of the application and any potential opposition encountered. On average, the procedure may span from 6 to 12 months.
